GENERAL CONDITIONS OF USE OF

PHNOM PENH, SIEM REAP AND SIHANOUK

INTERNATIONAL AIRPORTS


As of 1st January 2009


I. Airport Charges and Fees:

The use of Airport by aircraft and passengers is subject to charges and fees. The tariffs are set by Société Concessionnaire de l'Aéroport (SCA) required to continually enhance the rendered services in a non-discriminatory manner in accordance with the ICAO recommendations.


II. Calculation:

The tariffs are based on each aircraft Maximum Take Off Weight (MTOW) for parking and landing. This data is registered in the aircraft airworthiness certificate or, for lack of it, in the manufacturer manual.


III. Payments:

All charges shall be paid in U.S. Dollar (USD).

All payments shall be made to SCA, except for the Passenger Service Charge which is collected by Cambodia Airport Management Services (CAMS) on behalf of SCA.

Charter Flights
   The cash-only payment will be made before each departure flight.
   
 2.Regular / Scheduled Flights
  2.1Under any circumstances all Carriers are required to pay a two-month security deposit in cash or Bank Guarantee based on the estimated aeronautical charges (landing, parking and aerobridge usage) for a one-month scheduled flight.
 2.2
All aeronautical invoices are to be settled within forty five (45) days after the receipt of the invoice.
 2.3
In the event of late payment, SCA reserves the right at any time to forfeit any security deposit made in order to offset any outstanding sum owed to SCA.
 2.4
If for any reason the outstanding amount to be paid exceeds the deposit, the Carriers will be imposed a cash payment for each future dealing with SCA.
 2.5
In case of failure to comply with the above, SCA will impose an interest rate of 1.5% per month on the principal outstanding balance.
   
 3.
Value Added Tax (VAT)
  
A value added tax (VAT) or other taxes may be imposed by the Royal Government of Cambodia. SCA shall not be responsible for VAT-exemption or any other tax imposed and has the obligation to impose and collect on behalf of the Royal Government of Cambodia as per the invoicing.


IV. Traffic Form:

CAMS provides a Traffic Form for every aircraft movement (arrival or departure).

This document shall be filled out with following data: owner of the aircraft, operating company, airline company, aircraft registration number, Maximum Take Off Weight (MTOW), type of flight (regular passenger, charter, freight), movement (arrival or departure) with scheduled hours, load composition per flight section (passenger and freight), crew members, etc. (cf. IATA document).

Some of the Traffic Form data are used for calculating the amount to be charged. In case the Traffic Form is incompletely filled out, SCA shall reserve the right to apply the higher rates.

The Traffic Form is used as well for establishing statistic reports, regularly transmitted to the State Secretariat of Civil Aviation.

(a) Phnom Penh International Airport

The Landing Fees are to be paid for every landing in Phnom Penh International Airport. They are based on:
  • MTOW (Maximum Take Off Weight) of the aircraft
  • Nature of the flight (training, test, forced return, etc.)
  • Status of the flight (international or domestic)

MTOW in metric tons rate (in U.S. Dollar, tax excluded)

Domestic:

  • From 1 ton to 50 tons = MTOW x 3.50
  • From 51 tons to 100 tons = 175 + (MTOW - 50) x 5.70
  • More than 100 tons = 460 + (MTOW - 100) x 6.30

International:

  • From 1 ton to 50 tons = MTOW x 5.10
  • From 51 tons to 100 tons = 255 + (MTOW - 50) x 5.70
  • More than 100 tons = 570 + (MTOW - 100) x 6.30


(b) Siem Reap International Airport

The Landing Fees are to be paid for every landing in Siem Reap International Airport. They are based on:

  • MTOW (Maximum Take Off Weight) of the aircraft
  • Nature of the flight (training, test, forced return, etc.)
  • Status of the flight (international or domestic)

MTOW in metric tons rate (in U.S. Dollar, tax excluded)

Domestic:

  • From 1 ton to 50 tons = MTOW x 3.50
  • From 51 tons to 100 tons = 175 + (MTOW - 50) x 5.70
  • More than 100 tons = 460 + (MTOW - 100) x 6.30

International:

  • From 1 ton to 50 tons = MTOW x 5.10
  • From 51 tons to 100 tons = 255 + (MTOW - 50) x 5.70
  • More than 100 tons = 570 + (MTOW - 100) x 6.30


(c) Sihanouk International Airport

The Landing Fees are to be paid for every landing in Sihanouk International Airport. They are based on:

  • MTOW (Maximum Take Off Weight) of the aircraft
  • Nature of the flight (training, test, forced return, etc.)
  • Status of the flight (international or domestic)

MTOW in metric tons rate (in U.S. Dollar, tax excluded)

Domestic:

  • from 1 ton to 50 tons = MTOW x 3.50
  • from 51 tons to 100 tons = 175 + (MTOW - 50) x 5.70
  • 101 tons and more = 460 + (MTOW - 100) x 6.30

International:

  • from 1 ton to 50 tons = MTOW x 5.10
  • from 51 tons to 100 tons = 255 + (MTOW - 50) x 5.70
  • 101 tons and more = 570 + (MTOW - 100) x 6.30


VI. Parking Charge:

Phnom Penh International Airport, Siem Reap International Airport and Sihanouk International Airport.

The invoicing will be based on the following factors:

  • Aircraft MTOW
  • Status of the airline company (resident, non resident)
  • Type of parking stand used (traffic stand or remote stand)

Parking stands occupancy rate.

Resident Airlines:

  • Traffic Stand: USD 0.10 per ton per hour
  • Remote Stand: USD 0.05 per ton per hour

Remark - it could be modified as follows:

  • Traffic stand : USD 0.025 per ton per 15 minutes

Payment is due at the beginning of each quarter.

Non Resident Airlines:

  • Traffic Stand: USD 0.30 per ton per hour
  • Remote Stand: USD 0.15 per ton per hour

Free parking allowance: an aircraft using traffic stand (from 23:00Z to 14:30Z) upon arrival do not pay the first two hours of parking fees.

  • An aircraft performing several turnarounds during the same day can benefit from several allowances
  • After application of an allowance, the parking time is rounded off to the higher hour for a remote stand and to the higher quarter for a traffic stand
  • Traffic stands used at nights (17:00Z to 23:00Z) are invoiced at the remote stand rate


VII. Lighting Fee:

Aircraft landing between 18:00 and 06:00 are subject to a 10% additional charge on landing fees.


VIII. Passenger Service Charge:

All passengers connecting at Phnom Penh, Siem Reap, and Sihanouk International Airports are required to pay the Passenger Service Charge (PSC), which is collected by CAMS on behalf of SCA.

A security charge of three U.S. dollars (USD 3.00), including VAT, is charged to all departing international passengers.

Passenger Service Charge (PSC) for Domestic flights, from 1st September 2008 onwards, is included in the flight ticket with code “KX”.

For International flights, the PSC must be paid at the airport until further notice.

The Passenger Service Charges (payment in U.S. Dollar only), including tax, are as follows:

International Flights (payment in U.S. Dollar only):

  • Foreign passenger: USD 25.00
  • Cambodian passenger: USD 18.00
  • Foreign child (under 12 years old): USD 13.00
  • Cambodian child (under 12 years old): USD 10.00
  • Infant (under 2 years old): Exempted

Domestic Flights (payment in U.S. dollar only):

  • Foreign passenger: USD 6.00
  • Cambodian passenger: USD 5.00
  • Infant (under 2 years old): Exempted


IX. Loading Bridge Fee (for Phnom Penh International Airport):

The invoicing will be based on the aircraft MTOW.

X. Ground Handling Fees:


SCA has got an exclusive right to procure ground-handling services on Phnom Penh, Siem Reap, and Sihanouk International Airports. This activity is subject to a separate Agreement.


XI. Fuel Through-put Fee:

Per liter fees on fuel will be instituted at a later stage.


XII. Business-Lounge:

A business-lounge is made available to any Carrier. The conditions of access and rate are subject to a specific Agreement.


XIII. Discounts and Exemptions:

The following types of flights are entitled to a reduction:

  • Helicopters: 50% reduction on the Landing Charges
  • Training flights: 50% reduction on the Landing Charges
  • Test flights: 50% reduction on the Landing Charges

The following types of movement benefit from exemption of parking and landing fees:

  • Cambodian VIP flights or other foreign state VIP flights (approved by the Royal Government of Cambodia)
  • Foreign military flights, which have been approved by the Royal Government of Cambodia
  • Forced return
  • Flights used by the International Red Cross

Some passengers may be entitled to an exemption from the Passenger Service Charge:

  • Crew members
  • Passengers in direct transit

SCA and CAMS are fully committed to meet the requirements of the Cambodian Authorities in terms of safety, security and security controls performed on behalf of the Royal Government of Cambodia. Security of Air traffic and related activities at Phnom Penh, Siem Reap, and Preah Sihanouk Airports, including but not limited to enforcement and application of security procedure checks and controls, are the sole responsibility of the Cambodian Authorities. SCA and CAMS, its owners, directors, officers, employees and agents shall not be responsible or liable for any damages or claims that may arise from an Airports User or any other person or entity, for any damage to property, or injury or death, due to terrorism events, acts of war, or similar circumstances.
